Tap the “Treks” tab in the SCVNGR app and find the Mark Advertising Trek.
Treks are a series of challenges around Ohio’s North Coast that can be accomplished in any order, any time from August 2 – August 26. It is a great way to experience the area in an exciting, interactive new way.
By going to the places in the “Mark Advertising” Trek and doing the challenges in that trek. At each location in the trek, you’ll see two types of challenges; Mark Advertising challenges (featured up top) and normal SCVNGR challenges further down. At the very top highlighted in the “challenges in treks” section are the “Mark Advertising” challenges in the “Mark Advertising” Trek. Doing these challenges will earn you points in the “Mark Advertising” Trek. Doing the other challenges (in the second section further down) will earn you normal SCVNGR points. These will make you feel awesome, but DO NOT count for the “Mark Advertising” Trek.
Simply go to the “Treks” tab in the SCVNGR app. Find “Mark Advertising” and select it. You’ll see your score right at the top of the screen. (Please note: This score shows points earned from doing challenges in the Mark Advertising Trek. The score listed on your “profile” displays points earned for *all* the challenges you’ve done on SCVNGR, not just the special Mark Advertising ones.) You can also check the leader’s scoreboard at ant time to see your status amongst all players. Simply click “Activity” to see the trek leaderboard.
Complete challenges during the contest period in the “Mark Advertising” Trek to earn points. At the end of the contest period, the players with the most points will win the first, second and third place prizes. In the event of a tie, winners will be randomly selected for the top prizes.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE OR PAYMENT WILL NOT INCREASE OR IMPROVE YOUR CHANCES OF WINNING. Message and data rates may apply.
1. ELIGIBILITY. The “Mark Advertising Scavenger Hunt Sweepstakes” (the “Sweepstakes”) is open only to entrants who, as of the entry date, are at least eighteen (18) years old. The Sweepstakes is void in all other jurisdictions and where prohibited or restricted by law. Employees, officers and directors of Mark Advertising (“Sponsor”), SCVNGR, Inc. (“SCVNGR”), their respective parents, subsidiaries, affiliates, divisions, and the immediate families (defined as parents, spouses, children, siblings, grandparents, and their respective spouses) or members of the same household (whether related or not) of each such employee, officer and director, are not eligible to enter or participate. The Sweepstakes, and any website pages and advertisements relating thereto, is intended for viewing only within the eligible Sweepstakes territory, and entrants must be present in the eligible Sweepstakes territory at the time they enter.
2. ENTRY PERIOD. The Sweepstakes entry period begins at 12:01 p.m. Eastern Standard Time (“EST”) on August 2, 2013 and ends at 8:00 a.m. EST on August 26, 2013 (the “Entry Period”). SCVNGR’s computer is the official timekeeping device for this Sweepstakes.
3. HOW TO ENTER.
a. There are two (2) methods of entry in the Sweepstakes (online by using the SCVNGR location-based gaming application and by mail) as described below. You may obtain an entry in the Sweepstakes by checking in to Sweepstakes locations using SCVNGR and/or mailing in entries. LIMIT: One (1) entry per person in the Sweepstakes, regardless of method of entry.
(i) SCVNGR APP METHOD OF ENTRY: To enter by using the SCVNGR location-based gaming application (the “SCVNGR App”) you will need the SCVNGR App on a compatible mobile device. If you do not already have a SCVNGR account, follow the directions to download to your mobile device (utilizing the compatible Apple iOS operating systems or the Google Android operating systems) the free SCVNGR App, available at the iTunes App Store or the Android Marketplace, and complete the registration during the Entry Period. LIMIT: One (1) SCVNGR account per person. Multiple participants are not permitted to share the same mobile device or SCVNGR account. Registration for and use of the SCVNGR App, SCVNGR account, and other SCVNGR functions, systems and applications are subject to SCVNGR’s Privacy Policy and Terms of Service, and Sponsor has no responsibility or liability with respect to such registration or use. Standard data rates and/or message rates apply to application download, use and participation. Data plans, message plans or SCVNGR App/functionality may not be available through all wireless carriers or mobile devices. Entrants are solely responsible for any wireless, data and message charges; entrants should contact their carriers for pricing details. Not all wireless carriers participate. Participation in this Sweepstakes by mobile device means that you understand that you may receive additional messages by mobile device relating to this Sweepstakes, including to notify you if you are a winner, which may be subject to charges pursuant to your carrier’s rate plan.
During the Entry Period, in the SCVNGR App tap “treks” to search for “Mark Advertising”, and you can begin completing challenges at the Sweepstakes locations and earning entries in the Sweepstakes. TO EARN ENTRY IN THE SWEEPSTAKES USING THE SCVNGR APP METHOD OF ENTRY YOU MUST COMPLETE THE APPLICABLE CHALLENGE AT EACH SWEEPSTAKES LOCATION; USING OTHER FUNCTIONALITIES OF THE SCVNGR APP (FOR EXAMPLE, “CHECKING IN”) WILL NOT EARN ENTRIES. There are fourteen (14) Sweepstakes locations. Certain locations may have specified days and hours for challenges at that location. In order to take and complete the challenge at a Sweepstakes location, an entrant must be at the location as registered by the SVNGR App. and use entrant’s mobile device to access the SCVNGR App and follow the instructions to complete the challenge at his or her location that corresponds to the Sweepstakes location. NO PURCHASE OR PAYMENT IS NECESSARY AT ANY SWEEPSTAKES LOCATION IN ORDER TO TAKE AND COMPLETE A CHALLENGE AND EARN SCVNGR POINTS AND ENTRY IN THIS SWEEPSTAKES. All SCVNGR challenges must be completed during the Entry Period and, if applicable, on any specified day or hour(s). In the event of a dispute as to the identity of an entrant, the authorized account holder of the SCVNGR account will be deemed to be the entrant. Potential winners may be required to show proof of being the authorized account holder. The “authorized account holder” is the natural person assigned to the SCVNGR account by SCVNGR. Submitting mass challenges/entries or challenges/entries generated by a script, macro or use of automated devices is prohibited and will result in disqualification. Entrants who do not desire to enter by using the SCVNGR App method of entry may enter by mail as provided below.
(ii) MAIL-IN METHOD OF ENTRY: During the Entry Period, hand print your full name, complete home address, day and evening phone numbers, email address (if any), and age on a 3 x 5 inch piece of paper and send it by United States mail in a sealed envelope no larger than 9 1/2″ x 4 1/4″ (a #10 envelope) with correct postage to “Mark Advertising Scavenger Hunt Sweepstakes – Entry,” P.O. Box 413, Sandusky, OH 44870. LIMIT: One (1) entry per separately mailed envelope. All mail-in entries must be received by Sponsor during the Entry Period. No facsimiles, photocopied or mechanically reproduced entries allowed. Use of any automated system to submit entries is prohibited and will result in disqualification.
b. FOR ALL ENTRIES: LIMIT: One (1) entry per person in the Sweepstakes, regardless of method of entry. All entries, regardless of method of entry, must be received by Sponsor during the Entry Period (or during such certain dates and times within the Entry Period as noted above). All entries become the exclusive property of Sponsor and none will be acknowledged or returned. Proof of mailing or SCVNGR APP use/participation/check ins will not be deemed to be proof of receipt of entry by Sponsor. All entrants and entries subject to verification prior to the awarding of a prize, as are the eligibility, age and other claims of/information provided by a potential prize winner. Entrants will cooperate with Sponsor and its representatives in connection with any and all verification activities.
4. AGREEMENT TO OFFICIAL RULES AND DECISIONS. By participating in the Sweepstakes, each entrant fully and unconditionally agrees to be bound by and accepts these Official Rules and the decisions of Sponsor (including, without limitation, decisions regarding eligibility of entries, the selection of entrants and the winners, and the awarding of the prizes), which are final and binding in all respects.
5. DRAWINGS; ODDS; NOTIFICATION. On or before August 30, 2013, Sponsor will randomly select three (3) potential winners from among all eligible mail-in entries and those SCVNGR App entries with the highest SCVNGR point total received by Sponsor. Prizes will be selected in the order specified below, with one (1) winner selected per prize. Odds of winning a prize depend on the number of eligible entries received by Sponsor in the Sweepstakes. A selected entrant must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. A potential winner will be announced on Facebook.com/MarkAdvertising. It will be the sole responsibility of the winner to contact Mark Advertising via phone, email, mail or fax to notify acceptance of prize. A potential winner will be required to execute and return to Sponsor proof of eligibility, and, except where prohibited by law, a Publicity Release (an “Affidavit/Release”) in the form(s) provided by Sponsor in order to claim his/her prize. The Affidavit/Release must be returned to Sponsor by the date and/or time indicated within the Affidavit/Release. If a potential winner cannot be contacted within one (1) week of the first announcement on Facebook.com/MarkAdvertising, or if a potential winner fails to return the Affidavit/Release within the specified time, or if any prize or prize notification is returned as undeliverable, or if a potential winner is found to be ineligible, or if a potential winner does not comply with the Official Rules, then the potential winner may be disqualified and an alternate winner selected by Sponsor in his/her place at random from among all remaining eligible entries received by Sponsor for the Sweepstakes. In such event, an alternate potential prize winner will be notified as described above and will be required to return the required documents to Sponsor as described above; provided, however, Sponsor may alter the above timing to meet its Sweepstakes schedule and due to such schedule and any time-related nature of a prize, Sponsor may be unable to award such prize in this Sweepstakes. Sponsor is not responsible for the failure of a potential winner to receive Sponsor’s notification or the required documents for any reason, or for the inability of such potential winner to return the required documents for any reason. In the event of a prize forfeiture, no compensation will be given.
6. PRIZES.
a. Subject to the terms and conditions of these Official Rules, three (3) prizes will be awarded in this Sweepstakes, which prizes consist of and are limited to the following. The aggregate retail value (“ARV”) of all prizes to be awarded in this Sweepstakes is $600.
(i) One (1) $300 cash prize. ARV $300.
(ii) One (1) $200 cash prize. ARV $200.
(iii) One (1) $100 cash prize. ARV $100.
b. Prizes are nontransferable, and nonnegotiable. Prizes must be accepted as awarded. Prizes are awarded “AS IS” with no warranty, representation, or guarantee, express or implied, in fact or in law, made by Sponsor or for which Sponsor shall be liable, including, without limitation, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. No prize substitutions, except by Sponsor, who reserves the right (but has no obligation) to substitute a prize (or a component thereof) with another prize of equal or greater value if a prize (or a component thereof) is not available for any reason as determined by Sponsor in its sole discretion. Unused components of a prize shall be forfeited and have no redeemable cash value. Winner is solely and fully responsible for any and all costs, fees, taxes, assessments and expenses associated with prize award, redemption, receipt and use, including, without limitation, all federal, state and local taxes on the prize. Winners waive the right to assert as a cost of winning a prize any and all costs of verification and redemption or travel to redeem the prize. Non-compliance with any of the foregoing and any other condition of this Sweepstakes may result in disqualification and forfeiture of prize, in which case, no consideration will be awarded. Certain prizes may require a prize winner to execute and return to the prize supplier certain releases or other documents, or agreements, which actions are a condition to the award of the prize, are the responsibility of the prize winner, shall be coordinated by the prize winner and supplier, and Sponsor shall have no responsibility or liability with respect thereto. LIMIT: One (1) prize per person or address (physical or email) in this Sweepstakes.
7. PUBLICITY. Except where prohibited by law, participation in the Sweepstakes constitutes winner’s consent to Sponsor’s (and its designees’, successors’ and assigns’) use of winner’s name, biography, likeness, voice, photographs, video, opinions, statements, hometown, state and country for promotional purposes in any manner or media (including, without limitation, online), worldwide, in perpetuity, and without further payment, consideration, attribution, notice, review or consent.
8. GENERAL CONDITIONS. Sponsor reserves the right, in its sole discretion, to terminate, modify or suspend the Sweepstakes if, in Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if viruses, bugs, unauthorized intervention, fraud, technical difficulties or failures or any other factor beyond Sponsor’s reasonable control corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes. In such event, Sponsor reserves the right (but does not have the obligation) in its sole discretion to award prizes at random from among eligible, non-suspect entries received up to the time of suspected impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any website or undermine the legitimate operation of this Sweepstakes is a violation of criminal and civil laws, and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision or any other provision of these Official Rules.
9. RELEASE. By entering, each entrant forever and irrevocably releases and holds harmless Sponsor and affiliates, and their respective agents, and all of their respective employees, officers, and agents from and against all claims, damages or liabilities arising in whole or in part, directly or indirectly, from entrant’s participation and/or entry in the Sweepstakes and/or entrant’s award, receipt or use of any prize awarded in the Sweepstakes.
10. LIMITATIONS OF LIABILITY. Sponsor is not responsible for: (a) incorrect or inaccurate transcription of entry information or late, lost, stolen, unintelligible, illegible, damaged, mutilated, altered, incomplete, misdirected or postage due entries or entries received through impermissible or illegitimate channels, all of which will be disqualified; (b) technical failures of any kind, including but not limited to the malfunctioning of any telephone, computer online systems, computer equipment, website, server provider, network, hardware or software, including without limitation, failures of the SCVNGR App; (c) the unavailability or inaccessibility of any website or service, including, without limitation, the SCVNGR App; (d) unauthorized intervention in any part of the entry process or the Sweepstakes; (e) printing, typographical, electronic or human errors which may occur in the offer or administration of the Sweepstakes or the processing of entries; or (f) any injury or damage to persons or property, including but not limited to entrant’s computer, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes, or from viewing, playing or downloading any material from the SCVNGR App or Sponsor’s website(s), regardless of whether the material was prepared by Sponsor, SCVNGR or a third party, and regardless of whether the material is connected to the SCVNGR App or Sponsor’s websites by a hypertext link.
11. DISPUTES. Entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in federal, state or local courts; entrant submits to sole and exclusive personal jurisdiction to said courts in the State of Ohio for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (b) any and all claims, judgments, and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant or Sponsor in connection with the Sweepstakes shall be governed by, and construed in accordance with, the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules of provisions (whether of the State of Ohio, the United States, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Ohio.
12. DATA COLLECTION. Entrants provide personal information to Sponsor and SCVNGR when they participate in the Sweepstakes. Sponsor’s Privacy Policy is located at https://www.markadvertising.com/privacy-policy.php. SCVNGR’s Privacy Policy is located at http://scvngr.com/privacy. Notwithstanding anything to the contrary contained in any of such Privacy Policies, with respect to information collected in connection with this Sweepstakes, Sponsor and its designees collect this information and use it to (a) administer the Sweepstakes, (b) for market research and (c) for other marketing purposes. Sponsor and its designees may share this information with third parties who need access to this information to perform services on Sponsor’s behalf. Sponsor may also share this information with its affiliates and select marketing partners who may use it to contact you with information and offers they believe will be of interest to you. Sponsor’s affiliates include, without limitation, Mark Advertising. Entrants who receive emails from Sponsor or any other third party and who wish to unsubscribe must unsubscribe individually to each sender’s email.
13. OFFICIAL RULES. 14. WINNERS’ LIST. To request a list of the Sweepstakes winners, send a self-addressed postage-stamped envelope to “Mark Advertising Scavenger Hunt Sweepstakes – Winners’ List Request,” c/o Mark Advertising, P.O. Box 413, Sandusky, OH 44870. Requests must be received by October 31, 2013.
